Commercial Building Defects

We represent building owners, general contractors, subcontractors, developers and product manufacturers throughout the United States in pursuit or defense of defect claims. These claims cover problems such as defective structural design or defective construction techniques, roofing defects, inadequate framing, foundation deficiencies and site drainage problems. Our commercial clients include owners of hotels, office buildings, general contractors, subcontractors and material providers.

Although OSO makes every effort to resolve construction defect claims out of the courtroom, the key to success is preparing every case as if it will be tried to a judge or jury. As trial lawyers, we approach every case as if it will be in the courtroom someday. We believe this approach provides our clients the leverage necessary to favorably resolved claims.

Commercial buildings provide a unique set of problems when general contractors fail to deliver the product sought. Frequently, issues quickly expand due to the number of subcontractors and material providers involved in the construction. It is essential that the attorney become intricately involved at the beginning of the situation. It is important to contact subcontractors and material providers to ascertain potential financial liabilities and begin gathering facts from the peoplecompanies who have been involved on a daily basis. It is also important to organize and control subcontractors and material providers to reduce the impact of liens and minimize potential delay. As important is putting together the right experts to immediately address construction and design defects so there can be a resolution to all issues as quickly as possible.

OSO’s approach to commercial building litigation is based upon a team concept. The goal is to minimize cost to the client, but maximize organization and concentration on the issues that will further the client cause. OSO understands and works to balance between the fact that most office building owners are not flush with cash near or after completion of the building, but must protect the significant investment that has been made. The goal of OSO is to present issues in a persuasive manner so that a resolution can occur prior to going into the courtroom.
